Many aware commentators have fallen silent and bloggers have retired from the
keyboards lately, fearing the worst--that it is too late to stop the
momentum towards fascism and the loss of our basic human liberties
which at one point we called  "self evident" and universal-- too late
to reverse the process towards a "one world government" in which we
have no say about the future.

Can you be talked into handcuffing yourself?

The following video shows a perfect example of the wrong way to manage your federal government.

Daniel Ellsberg (of Pentagon Papers fame) and his interviewer Tim Ferriss, whose expertise includes "peeling hardboiled eggs without peeling," urge you to watch what Ferriss labeled "the most important video you watch in your lifetime."

Three times in this video, Ellsberg and Ferriss refer to your constitutional republic as a "democracy." In order to make your "democracy" work, they say, you should watch the 18-minute video and then take 60 to 120 seconds to call or e-mail your US Senators and Barack Obama to tell them not to vote for the FISA bill.

The reason you should object to your Senators voting for this bill is that it "guts the Fourth Amendment." For those without fishing and hunting experience, that means that the FISA bill will change the Fourth Amendment. For those without Bill of Rights experience, the Fourth Amendment to the Constitution says this:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
If the Fourth Amendment is important to you, then make sure you know what those 54 words mean. There are only 15 nouns and a handful of common verbs--nothing you haven't heard before.

One thing you hardly ever hear, though, is this: Congress can't change the Constitution. Not even if the president signs the bill. Not even if the radio talk show hosts, TV news anchors, and weekend TV news commentators pretend otherwise. The Constitution describes clearly the processes for amending the Constitution. The processes are found in Article 5, outlined here. If these procedures are not followed, then the Constitution remains unchanged.

Here's another thing you hardly ever hear: "All laws which are repugnant to the Constitution, are null and void." Chief Justice Marshall, Marbury v. Madison, 5, U.S. (Cranch) 137, 174,176

Restated with greater detail:
"[a]n unconstitutional act is not a law; ... it imposes no duties; it is, in legal contemplation, as inoperative as though it had never been passed." Norton v. Shelby County, 118 U.S. 425, 442 (1886).

"An unconstitutional act is not a law; it binds no one." Huntington v. Worthen, 120 U.S. 97, 101-02 (1887).

"An unconstitutional law is void, and is as no law. An offence created by it is not a crime." Ex parte Siebold, 100 U.S. 371, 376 (1880), quoted with approval in Fay v. Noia, 372 U.S. 391, 408 (1963).
Now when you watch this "most important video you watch in your lifetime," you'll know when to laugh your ass off.

One thing you should always do is note which of your federal legislators violate their oaths of office. The oath of the members of the House and Senate goes like this:
I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.
The president also swears not to violate the Consitution:
"I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States."
Every two years you can fire 100 percent of the House of Representatives and one third of the Senate. Every four years you can elect a new president. That's when you need to leap into action and do your best to clean house. But between elections you certainly don't need to call or e-mail any member of Congress to tell him to obey the Constitution. He already took an oath to do that, and you took an oath to fire the son of a bitch if he violated his oath. Didn't you? Well you can do that right now.
